International Opium Convention in Geneva, February 19, 1925

Entry into force

:

September 25, 1928, in accordance with Article 36.

Ratifications or definitive accessions:

Germany (August 15, 1929) : Subject to the reservation annexed to the minutes of the plenary session of February 16, 1925. (The validity of the signature and ratification of this Convention are subject to the condition of the presence of a German expert as a member of the Central Committee.)

Argentina (April 18, 1946) Austria (November 25, 1927) Belgium (August 24, 1927) : Does not involve the Belgian Congo or the territory of Ruanda-Urundi placed under the mandate of Belgium. Belgian Congo and mandated territory of Ruanda-Urundi (17 décembre 1941 a)

Bolivia (April 15, 1932 a)1. Does not undertake to restrict the cultivation or production of coca in the country, nor to prohibit the use of coca leaves among the indigenous population. 2. The export of coca leaves shall be subject to the control of the Bolivian Government by means of export certificates. 3. For the export of coca, the Bolivian Government designates the following places: Villazon, Yacuiba, Antofagasta, Arica and Mollendo.

Brazil (June 10, 1932) British Empire (February 17, 1926) : The ratification does not extend to the Dominion of Canada or the Irish Free State, and, in accordance with the power reserved under Article 39 of the Convention, the said ratification does not bind the Colony of Bahamas or the State of Sarawak under the protection of Her Britannic Majesty.

  4. The Swiss Federal Political Department, by letter dated 15 July 1936, informed the Secretariat that:
" According to the arrangements concluded in 1929 and 1935 between the Government of the Principality of Liechtenstein and the Swiss Government in application of the Customs Union Treaty of 29 March 1923 between these two countries, Swiss legislation on narcotics, including all measures taken by the federal authorities in execution of the various international conventions relating to dangerous drugs, is applicable, for the duration of the Customs Union Treaty, to the territory of the Principality in the same manner as to the territory of the Confederation. Consequently, the Principality of Liechtenstein participates, for the duration of the said treaty, in the international conventions concluded or to be concluded on narcotics without it being necessary or appropriate for it to accede to them separately."

  2. In a notification received on 21 February 1974, the Government of the German Democratic Republic indicated that the German Democratic Republic had declared the reapplication of the Convention as of 7 April 1958.

In this regard,

The Secretary-General received on 16 March 1976 the following communication from the Government of the Federal Republic of Germany:
" The Government of the Federal Republic of Germany declares, with regard to the communication of the German Democratic Republic, dated 31 January, concerning the application as from 7 April 1958 of the International Opium Convention of 19 February 1925, that, in the relations between the German Democratic Republic, the effect of this declaration does not extend beyond 21 June 1973."

Subsequently, in a communication received on 17 June 1976, the Government of the German Democratic Republic stated:
" The Government of the German Democratic Republic is of the opinion that, in accordance with the applicable rules of international law and the international practice of States, the regulation of the reapplication of agreements concluded under international law is a matter within the internal competence of the successor States concerned.

The German Democratic Republic is therefore entitled to determine the date of reapplication of the International Opium Convention of 19 February 1925, to which it has declared itself to be a party by way of succession."
