CONVENTION FOR LIMITING THE MANUFACTURE AND REGULATING THE DISTRIBUTION OF NARCOTIC DRUGS

1. The Government of the United States of America reserves the right to apply, for the purpose of exercising internal control and of controlling the imports and exports of opium, coca leaves and all derivatives thereof, and similar synthetic products, from territories under its jurisdiction, measures more stringent than the provisions of the Convention.

2. The Government of the United States of America reserves the right to apply, for the purpose of exercising control over the transit through its territories of raw opium, coca leaves, all their derivatives and similar synthetic products, measures under which the granting of an authorization for transit through its territory may be subject to the production of an import permit issued by the country of destination.

3. The Government of the United States of America sees no possibility of undertaking to send to the Permanent Central Opium Board statistics of imports and exports before a period of sixty days from the end of the three-month period to which such statistics relate..

4. The Government of the United States of America does not see the possibility of undertaking to indicate separately the quantities of narcotics purchased or imported for State needs..

5. The plenipotentiaries of the United States formally declare that the fact that they have this day signed, on behalf of the United States of America, the Convention for the Limitation of the Manufacture and Regulation of the Distribution of Narcotic Drugs, shall not be construed as meaning that the Government of the United States of America recognizes any regime or entity that signs or accedes to the Convention as constituting the government of any country, when that regime or entity is not recognized by the Government of the United States of America as constituting the government of that country.

6. The plenipotentiaries of the United States of America further declare that the participation of the United States of America in the Convention for the Limitation of the Manufacture and Regulation of the Distribution of Narcotic Drugs, signed this day, does not imply any contractual obligation on the part of the United States of America to any country represented by a regime or entity that the Government of the United States of America does not recognize as constituting the government of that country, so long as that country does not have a government recognized by the Government of the United States of America.

The Japanese Government declares that in view of the necessity for close co-operation between the High Contracting Parties, with a view to carrying out most effectively the provisions of the Convention for Limiting the Manufacture and Regulating the Distribution of Narcotic Drugs, signed at Geneva on July 13, 1931, it considers that the present position of Japan, irrespective of whether it is a Member of the League of Nations or not, should be maintained with regard to the composition of the organs and the appointment of the members of those organs as mentioned in the said Convention.

a) The Republic of El Salvador does not agree with the provisions of Article 26, since there is no reason why the High Contracting Parties should be granted the power to withdraw their colonies, protectorates and overseas territories under mandate from the effects of the Convention..

b) The Republic of El Salvador declares its disagreement with the reservations contained in Nos. 5 and 6 of the Declarations made by the Plenipotentiaries of the United States of North America concerning governments not recognized by the Government of that country, reservations which, in its opinion, infringe the national sovereignty of El Salvador, whose present Government, although not recognized until now by that of the United States, has been recognized by the greater part of the civilized countries of the world; if these countries have recognized it, it is because they are convinced of its perfectly constitutional character and convinced that it provides a full and complete guarantee of the fulfillment of its international duties, given the unanimous, decided and effective support it enjoys on the part of all the inhabitants of the Republic, citizens of that country or foreigners domiciled there.

The Republic of El Salvador, respectful of the internal regimes of other nations, considers that the Convention in question, of a strictly hygienic and humanitarian nature, does not provide a suitable opportunity to formulate reservations of a political nature such as those which motivate the present observation..

  2. On 3 October 1983, the Secretary-General received from the Government of Argentina the following objection :

"[The Argentine Government] formally objects to [the declaration] of territorial application made by the United Kingdom in respect of the Malvinas Islands and their dependencies, which it illegally occupies under the name 'the Falkland Islands'.

The Argentine Republic rejects and considers null and void [said declaration] of territorial application."

In response to this communication, the Secretary-General received, on 25 February 1985, from the Government of the United Kingdom of Great Britain and Northern Ireland the following statement :

" The Government of the United Kingdom of Great Britain and Northern Ireland has no doubt as to its right to extend, by notification to the depositary in accordance with the relevant provisions of the above-mentioned Convention, the application of the said Convention to the Falkland Islands or, as the case may be, to their dependencies.

For this reason alone, the Government of the United Kingdom cannot attribute any legal effect to the communication from Argentina."

  5. Before ratifying the Convention with the accompanying declaration, the Japanese Government consulted the Contracting Parties, through the Secretary-General. A summary of the correspondence exchanged on this occasion was published in the Official Journal of the League of Nations of September 1935 (16th year, No. 9).
  6. The Swiss Federal Political Department, by letter dated 15 July 1936, informed the Secretariat of the following:

" Under the arrangements made in 1929 and 1935 between the Government of the Principality of Liechtenstein and the Swiss Government in application of the Customs Union Treaty concluded on 29 March 1923 between these two countries, Swiss legislation on narcotics, including all measures taken by the federal authorities in execution of the various international conventions relating to dangerous drugs, is applicable, for the duration of the Customs Union Treaty, to the territory of the Principality in the same way as to the territory of the Confederation. The Principality of Liechtenstein therefore participates, for the duration of the said Treaty, in the international conventions concluded or to be concluded on narcotics, without it being necessary or appropriate for it to accede to them separately."

  1. In a notification received on 21 February 1974, the Government of the German Democratic Republic indicated that the German Democratic Republic had declared the reapplication of the Convention as from 7 April 1958. In this connection, the Secretary-General received on 16 March 1976 the following communication from the Government of the Federal Republic of Germany:

" The Government of the Federal Republic of Germany declares, with regard to the communication of the German Democratic Republic dated 31 January 1974 concerning the application as from 7 April 1958 of the Convention for Limiting the Manufacture and Regulating the Distribution of Narcotic Drugs of 13 July 1931, that in the relations between the Federal Republic of Germany and the German Democratic Republic the effect of this declaration does not extend beyond 21 June 1973."

Subsequently, in a communication received on 17 June 1976, the Government of the German Democratic Republic stated:

" The Government of the German Democratic Republic is of the opinion that, in accordance with the applicable rules of international law and the international practice of States, the regulation of the reapplication of agreements concluded under international law is a matter within the domestic competence of the successor States concerned. Consequently, the German Democratic Republic is entitled to determine the date of reapplication of the Convention for Limiting the Manufacture and Regulating the Distribution of Narcotic Drugs of 13 July 1931, to which it has declared itself to be a party by way of succession. :"
